MARCH 18, 2025 | Protecting Attorney-Client Privilege in Response to Japanese Government Investigations

The attorney-client privilege is an important right that protects confidential communications between a client and their attorney. However, the Japanese legal system does not provide the same level of protection for the privilege as the legal systems of the United States. This can create unique challenges when responding to disclosure requests and dawn raids by Japanese government agencies, which may call for disclosure of privileged communications.

This seminar is a follow-up of the presentation provided by Morrison Foerster in September 2023. The presentation will be in an interactive, Q&A style covering the following topics, using real-life examples:

  • Investigations by Japan Fair Trade Commission and Consumer Affairs Agency
  • Differences between Japanese and U.S. regulatory investigations
  • Criminal investigations
